Terms of Service

This is a translation of the Italian Terms of Service. The two versions have the same content; if they ever differ, the Italian version prevails.

Welcome to Duskhearth ("the App", "the Service"). The Service is provided by Cristian Palestrini, an individual developer ("the Owner", "we", "us"), who can be reached at support@duskhearth.app.

By using the App you accept these Terms of Service ("Terms"). If you don't accept them, you may not use the Service. You must be at least 18 years old to use the Service: minors cannot sign up, not even with a parent's consent. We ask you to confirm this the first time you sign in.

1. What the Service is

Duskhearth is a mobile app that lets groups of players play roleplaying campaigns compatible with the 5th edition asynchronously: a Narrator powered by artificial intelligence tells the story in response to the actions the players send, and everyone plays at their own pace, without having to meet at the same time.

The 16+ rating you see on the stores describes the App's content (fantasy violence, no explicit content). Who can sign up is a separate matter: the Service is reserved for adults and is not intended for anyone under 18.

2. Account

To use the App you must create an account (email and password, or sign-in with a third-party provider where available). You are responsible for keeping your credentials confidential and for everything that happens with your account. You must provide a valid email address and truthful information when you sign up.

We reserve the right to suspend or close an account if these Terms are breached, if the user behaves abusively towards other users, or if the Service is used for unlawful purposes. We also close the account if we learn that it belongs to someone under 18.

3. Content you submit

While playing, you submit text (your character's name and description, background elements, game actions, messages) and, if your plan allows it, a profile photo, which the other players in your campaigns can also see. You keep ownership of what you submit, but you grant us a non-exclusive, royalty-free license, valid for the whole duration of the Service, to use, process and transmit that content — including transmitting it to third-party artificial intelligence services — for the sole purpose of providing you with the Service (narrating your campaign, keeping the narrative memory, generating your character sheet, and so on).

Do not post content that is illegal, infringes the rights of others, contains sensitive data of other real people, includes photos of other people without their consent, or is sexually explicit or incites hatred or real-world violence (which is different from ordinary fantasy combat narration, a normal part of the game). We reserve the right to remove content or suspend accounts that break this rule.

3.1 Zero tolerance for offensive content and abusive users

We have a zero-tolerance policy for content that is offensive, harassing, discriminatory or otherwise in breach of these Terms — whether it is a game action, a user's profile name or photo, or any other user-generated content.

Every player can report from the app an action, an avatar or a piece of AI narration they consider inappropriate. We commit to reviewing every report within 24 hours of receiving it and, if it is well founded, to removing the content and/or suspending the account responsible. The suspension may be temporary or permanent, at our discretion, depending on how serious the breach is.

3.2 How to report and how we decide

Besides the "Report" button in the App, anyone, even without an account, can report content they believe is illegal by writing to support@duskhearth.app: tell us where the content is and why you believe it is illegal.

Reports are reviewed by a person: we don't use automated systems to remove content or suspend accounts. The measures we can take are removing the content (for a profile photo, reverting to the default image) and suspending the account temporarily or permanently.

If we take one of these measures against you, we write to the email address of your account explaining what we decided, about which content and why, unless the law prevents us from doing so. If you disagree, you can appeal the decision by replying to that email or by writing to support@duskhearth.app within six months: we review it and get back to you. Whoever made the report receives the outcome in the same way.

4. Content generated by artificial intelligence

The narration, the non-player characters, the events and the outcomes you read in the game are generated by an artificial intelligence model (currently Anthropic's Claude models). Although we work to keep the narration consistent with the App's 16+ rating and apply content filters, the AI may occasionally produce text that is inaccurate, inconsistent with the game rules, or not fully in line with our guidelines. AI-generated content is in no way professional, legal, medical or psychological advice. To use the features that rely on AI, the first time you sign in we ask for your consent to send your content to the providers listed in the Privacy Policy; if you don't give it, or you withdraw it, those features stay locked.

If generated content seems seriously inappropriate to you, report it from the app ("Report" button next to the narration) or write to us at support@duskhearth.app.

5. Subscriptions and payments

The Service is offered under the Adventurer plan (free) and the paid Hero and Legend plans, each with a different number of campaigns you can create, maximum length, number of players and live sessions allowed. The exact features of each plan are shown in the App and may change over time; any substantial unfavorable change does not apply to campaigns already created until they end (see point 5.4 below).

5.1 Purchase and automatic renewal

Paid subscriptions are automatically renewing subscriptions (monthly), purchased through the Apple App Store or Google Play, depending on the platform you use. Payment is charged to your Apple ID / Google Play account when you confirm the purchase. The subscription renews automatically at the end of the current period unless you cancel it at least 24 hours before the current period ends. Your account will be charged for the renewal within the 24 hours before the end of the current period. The exact price is clearly shown to you before you confirm the purchase.

5.2 Management and cancellation

Payments are handled entirely by Apple or Google: we have no access to your payment details and cannot process refunds or cancellations directly. To manage or cancel a subscription, or to request a refund, use your account settings in the App Store (iOS) or Google Play (Android), or contact Apple/Google support directly. Apple's and Google's refund policies apply to purchases made on their respective platforms.

5.3 Right of withdrawal (EU users)

If you buy as a consumer residing in the European Union, you normally have the right to withdraw from a contract concluded online within 14 days. By confirming the purchase of a subscription, you expressly agree that the Service starts immediately and acknowledge that, as a result, you lose your right of withdrawal once the Service has been fully or partly performed (art. 59 of the Italian Consumer Code / art. 16 of Directive 2011/83/EU). You can still cancel the automatic renewal at any time, as explained in point 5.2.

5.4 Changing or ending your plan

If you cancel or downgrade your subscription, the campaigns you have already created keep the features they were created with until they naturally end (for example maximum length and number of players). You won't be able to create new campaigns beyond the limits of your current plan, or start new live sessions beyond your current plan's budget.

5.5 Price changes

We reserve the right to change the prices of the paid plans. Changes do not apply retroactively to subscriptions already active until their next renewal, and they will be communicated to you in the ways provided by Apple/Google before they take effect.

5.6 Fair use limit

In addition to the limits shown in the App for each plan (number of campaigns, length, players, live sessions), we apply a fair use policy to prevent abuse and keep the service stable for all users. If your use of the Service in a given month goes beyond a reasonable threshold for your plan, we may temporarily prevent you from creating new campaigns until the following month, unless you move to a higher plan. Campaigns you have already started are never interrupted, slowed down or limited by this policy. If this limit applies to your account, we tell you clearly in the App when you try to create a new campaign.

5.7 "Support development" purchase

Besides subscriptions, the App offers a single, optional purchase, "Support development", which does not renew. It helps cover the costs of the Service and only gives a cosmetic recognition (the title "Patron" next to your name): it does not unlock features, does not change your plan and gives no gameplay advantage. It is not a donation to an organization and does not entitle you to any tax benefit. If you reinstall the App or change device, you get it back with "Restore purchases". Points 5.2 and 5.3 apply to withdrawal and refunds, because the recognition is given to you immediately after the purchase.

6. Acceptable use

You agree not to:

• use the Service for illegal purposes or in breach of these Terms;
• try to access other people's accounts or other users' data;
• use bots, scripts or automated tools to interact with the Service outside the App itself;
• try to manipulate, bypass or compromise the AI Narrator, the anti-abuse systems or the technical limits of the Service;
• resell, redistribute or commercially exploit the Service without our written consent.

7. Intellectual property

The App, its code, its design, the "Duskhearth" marks and the content we create are owned by us or licensed to us. You acquire no rights over them by using the Service, except the personal, non-transferable license to use the App granted by these Terms.

8. No warranty and limitation of liability

The Service is provided "as is". We do not guarantee that it is free of errors, always available, or that the AI narration is always accurate, consistent or free of unwanted content. To the maximum extent permitted by applicable law, we are not liable for indirect damages, loss of game data (for example a campaign's progress) or interruptions of the Service, except in cases of willful misconduct or gross negligence, and without prejudice to the mandatory rights that applicable law grants to consumers.

9. Suspension and termination

You can stop using the Service at any time. We can suspend or close your account if these Terms are breached, telling you the decision and the reasons and giving you the chance to appeal it, as described in point 3.2. If the account is closed, your campaign data may no longer be accessible; our Privacy Policy applies to the handling of your personal data.

10. Changes to these Terms

We may update these Terms over time, for example to reflect new features or legal requirements. Substantial changes will be communicated to you before they take effect, through the App or at your account's email address. Continuing to use the Service after a change means you accept the new Terms.

11. Governing law

These Terms are governed by Italian law. If you act as a consumer residing in the European Union, you keep the protection of the mandatory consumer protection rules of your country of residence, including the competent court provided there.
